What does it take to be an accomplice?

An accomplice is someone who knowingly, voluntarily, and with common interest, participates in the commission of a crime, and can be charged with the same crime(s) for which the accused will be tried. The law does not recognize accomplices to any misdemeanor or the crime of treason.

is it true that you cannot be charged with accomplice to a misdemeanor? also, can you be charged with accomplice if the principal is not arrested?

Answers:
depends on the state your in..each Penal Code is different. In Texas it is not a defense if the other party was not arrested that you are not charged as a party to the crime and there is nothing specific about misdemeanors or felonies, but like I said you have to go straight to the source research online the state's Penal Code.
