Is anyone petitioning against the smoking ban?
Im not an expert on the law, but surely we have some personal rights, as do non smokers.

I don't know any. But you are right we have personal rights, which is why public smoking is being banned in a lot of places. You have the right not to be subjected to things that can kill you.
there are more non-smokers who despise smoking than there are smokers who despise non-smokers. smokers will always lose out.
I don't know, but some barristers should and probably are studying the legislation right now. Let's hope they can get it thrown out.
Are you not allowed to smoke in your home? Are you not allowed to smoke in your own car? You have those rights. Non Smokers have the right to not breath your smoke while in public.
This is absolutely absurd. No where can I go and "not" smoke; everywhere I go, people are standing around smoking. I can not go to a grocery store, Wal-Mart, K-Mart, Target, Sears, J. C. Penney, the VA or local "hospital" without going through a haze of smoke.
Just for once, I would like for non-smokers to have as many rights as smokers! JUST ONCE!

That said, your right to smoke is inviolate as long as it doesn't impinge on my right not to breathe your smoke.

We've had it up here in Scotland for over a year now and it is wonderful.
i cant wait for it to be banned in most businesses Im alergic to cigarett smoke so for me it will be a godsend to be able to go to a bar and not die.

Yes people do petition smoking bans. Everyone has the right to say what they like or dislike.
I'm afraid that anyone who tries to get the smoking ban overturned is flogging a dead horse.

I've been a smoker for years and believe me, you get used to it. The ban isn't really hurting anyone.
Try the downing street web site under leisure. A petition is asking the government to stand by it's 2005 manifesto on smoking in public places.
Amazing isn't it. The anti-smoking brigade with their holier than thou attitude. "we can't walk down the street now without seeing people with cigarettes" - "we can't go to the pub without someone sitting outside having a cigarette and having to walk through a cloud". Well there's tough sh*t. It's what you wanted & it's what you've got. Learn to live with it.
thank god for the smoking ban !! i am a non-smoker and have had it with taking in second hand smoke ... i think the phrase my freedom ends where your freedom begins . is right for the smoking ban if you want to have a right to smoke i also have the right not to inhale your second hand smoke ... and since i am the one that is getting the side effects from 2nd hand smoke i don't want anyone smoking around me ... i have the right to refuse you smoking beside beside me because it directly effects me ... it would be like if someone was waving a baseball in the air and saying it's ok it's my right and i can do it anywhere ... the only difference is smoking is a n invicible baseball bat that hits you in the lungs slowly.
I am a smoker but I would love every smoker to give up. Just to please the NON smokers, just think how much it will effect them eh?
Taxes will have to rise to offset the £1.2bn revenue raised by the government from smokers.
Then every tax payer in the country will be paying higher taxes just because some people don't want others having a choice.
The day drinking, being obese, and driving cars is banned, is the day I will give credit to the "I don't want to inhale smoke" crowd.
Drunk driving really does kill innocent people. Those that are obese really do drive up health insurance costs. Car exhaust really does harm to our air, land, and water.
Targeting smokers is just a "feel good", all talk, minimal action measure.

i dont like breathing in smoke or smelling of it
after having a night out this week i noticed the differance greatly that the bar appeared cleaner
when people returned from the smoke out side i did notice the smell of fags on them
not the most endearing thing
you are probably right there will be some rights that have been trampled on but it must have been looked at in great detail to have got to this stage
More than personal rights we should have. I call them equal rights. If they have a restaurant for only non-smoking patrons, then for Heavens sake, make a restaurant for only smoker's! They do have exhaust air-conditioner's, even before they took away the rights of smoker's. I swear on my child's life, ffs, that NO human, or animal has ever died, or even became ill from 2nd hand smoke. It is a lie told by the government for money, and control of the people. A fear tactic.
All these poncy people banging on about how it's good there is a smoking ban so many have dusted off there halos that light pollution is on the increase. What does it matter if you die a bit earlier its doesn't matter we all live way too long anyway. If smoking was the only polluting sin then fine but hang on cars chemicals planes blah blah blah, ooh and my father died of cancer and so what he had to die of something etc
The issue of the smoking ban is currently being pursued in the ECJ on the basis that it infringes Article 8 of the Human Rights Convention - the right to enjoy private life etc. However I wouldn't hold your breath as this article clearly relates to private life and smoking has only been banned in public places.
Us smokers no longer have rights.
I'm now more of a social outcast than I ever was before.
I'm now told I can't smoke for up to half an hour in my own home if I have a worker/repairman coming to visit me.
Well in futer I'll demand they give me a bit more of a specific appointment instead of saying between 12 and 5pm.

subaru222 where was it stated that it was the will of the people about the smoking ban It was never put to a public vote things may have been diferent if it had gone to a public vote.
doesnt matter if they pettition or not as the rules are made by people who fund politicians*
*meaning they are the ones who decide if the ban is good or not.

No, smokers do not have any right to smoke in a public place. Parliament is sovereign, and accountable to people. No human rights apply in the human rights Act, or the UNDHR (United Nations Declaration on Human Rights).
One remedy may be to challenge the validity of the Act of parliament that came into force, but that would be futile. The courts cannot strike down a valid act of parliament.
