Answers:
Dear 7321,
There' are law protecting a person. It''s call The 'civil law'.
The right to defense yourself with or without lawyer in court or elsewhere.
To prosecute a charge, there must be evidence to proof under the Laws of evidence and the rules of engagement.
If there's nothing to proof, the court will dismiss the cast under
1. There is no case to answer
2. Under prima facie.
3. Technicals fault
The other thing is called "Defamation"
Statement that make false claim. Its prejudice done.
In school, especially public, they don't care as long as someone come up and back up your wrong doing. People can accuse you of anything they want.
You are been accuse, you can take a legal action and charge back in court under false charge and claim damage to the person that charge you in court or elsewhere. This will go to your school.. Ask for the proof. Let the teacher be the judge.
What ever it is, you can sue in court. Let them accuse you wrongly in school. They might win in school but not in court.
If this really happen, I petty you.
I hope this will help you. Used this. This civil right in law and
order is every where in this world.
I wish you the best of luck to defense yourself.
No they shouldn't be allowed to take action.
innocent until proven guilty.
You can sue for slander
In the U.S. :
People can accuse you of anything they want. But the burden of proof is with them. They have to come up with the proof of your wrong doings.
You are innocent until proven guilty.
Now if this is 'school' there are school rules. But they still must obide by State and Federal law.
if its public school they dont care as long as some one says you do your fucked..
Yes I someone accuse wrongly with no facts backing up their accusations you can sue them for the prejudice done.
It is called defamation.
In law, defamation is the communication of a statement that makes a false claim, expressly stated or implied to be factual, that may harm the reputation of an individual, business, product, group, government or nation. Most jurisdictions allow legal actions, civil and/or criminal, to deter various kinds of defamation and retaliate against criticism.
hiiiiiiiiiiiiiii every good girl
If the person has no proof of what you've done, it's just hearsay. Unless they have evidence that you've done something, they shouldn't be able to take any action against you.
Be careful. If you have a reputation to cause trouble or something the teacher will usually take the persons word for it. If you haven't actually done anything I see no reason why the teacher has any justification to take action against you. If the teacher does, complain to the school.
