What is a man who has pleaded guilty to indecent assault on a minor likely to get?
My step daughter was indecently assaulted by her Grandfather (My husbands ex-wifes Father) she was 13 at the time of the assault (and not in our care) but is now age 16.
This disgusting excuse of a human has also abused 4 other members of the family. The CPS court case was put together charging him with all the cases but the other 3 cases were weak as the children involved were young and two had learning difficulties.
On his solicitors advice this man denied all the other charges except the indecent assault charge on my step daughter, and pleaded guilty to this. As a result all the other charges have been dropped (due to lack of evidence) and he is to be sentenced only for my step daughters assault.
He has good references from his work (prison officer) and no criminal record.
What is he likely to get?
We have been told he is on the sex offenders list, but if thats all he will get we want to prepare ourselves.

It’s a very difficult one to call.
I used to work as a Teacher at a Midlands Cat B jail.
I was "privileged" NOT to work on the Sex offender’s wing better known as the Vulnerable Wing.
There seems to be no rhyme or reason to what these dreadful people get.
Suffice it to say h will NEVER work in the field he was previously involved in again, I think you said in your question that he was a Prison Officer.
This will also go against him as he is in a privileged position and should there fore "KNOW better".
The chances are that though the other instances have been dropped this will come up when he is sentenced which is why the CPS has dropped the weaker cases.
The best you can hope for is probably around 3 years, sex offenders list (known as List 99).
He will probably serve half this time.
He may well have to report for several years to a counselling service and also will possibly not be allowed to own or use a computer.
The thing to remember is that IF he does time and he is likely to do some at some point he will be known for his job both by the staff and the inmates.
He may well get what he deserves from the inmates at some point as often they start in the main areas of the prison put there by the Reception Staff to "teach him a lesson" he will also often be taught by others on the Vulnerable wing as he will be among the lowest of the low as he has offended probably against children with learning difficulties which even for the sex offenders is a no no.
I guess it a case of wait and see.
But usually what happens is when he is found guilty the judge will do one of two things.
First if he pleads the judge will take this into account BUT CPS are not stupid and they may well make it known that there are other cases being investigated or that charges are dropped so the judge is aware of this and it will then be taken into account.
In some ways it would be best if he pleads not guilty as then when he is found guilty as he no doubt will with a 13 year olds testimony he will get a longer sentence.
Finally when he is released he will have to remain on the Sex Offenders list and as the law now stands under the new law FOIA the Freedom of Information Act it is now possible and rightly so that these people are known to the public where they take abode
Also he will be all over the papers and news as he is in the public domain already given his job if I understand right what you said.
The law and its application by Judges is very odd. I had two inmates who had committed the identical same offence.
One had 100,000 indecent images of children some performing gross acts of indecency and were being molested by adults on his computer and got ten years, the other had 100,000 images and got 99 years which is in effect “At Her Majesties Pleasure and they both committed the same offence with similar images and the same Judge gave sentence to both, weird.
So good luck and let the child know that she must talk about what happened to her and that no one will judge her for what she was put through, she is TOTALLY innocent.

Unfortunately he probably will not go to prison, maybe some rehab programme or something lame like that. The system stinks but at least he'll be on sex offenders register which will protect others from him. Its crap, you get more for a driving offence nowadays. f you are not happy you could ask for an appeal for a stronger punishment but be warned it can go either way if you do. Good luck and well done to your step daughter for coming forward and facing it, more people need to have her courage.
judging by the state of the sentances handed out lately not a lot.If this was my daughter i would make sure that piece of s*** suffered for the rest of his miserable life even if i ended up in gaol for the rest of mine
I take it you haven't seen the news today about the guy walking free after admitting to sexual abusing several children as young as 18 months?
Dude they don't want them in prison its costs too much keeping the other inmates from cutting their testicles off and sticking them in their mouths.
I am not telling you what to do thats up to you but if someone did that to my daughter I would kill them in a very brutal and painful fashion.
I sympathise. These people are a real and present danger. There is a mountain of evidence that says they cannot be reformed. The sad truth is that he is likely to get another chance to continue his abuse. I seriously don't know how we should deal with such offenders, but a starting point ought to be to understand that they are exceptions to the normal rule of law and we need an exceptional way of dealing with them.
I'm afraid that because the scum has plead guilty he will more than likely not get a custodial sentence. As he has been found guilty you cannot appeal the sentence, only the conviction. Lets hope word gets out and the decent folk will give him the life sentence he so richly deserves.

Not nearly as much as he should get on record - but as soon as the inmates at his workplace find out he could end up with a lot of nasty things happening - if they aren't aware - make them aware - I know that there is a totally ruthless code in place in prisons for kiddyfiddlers - regardless of which side of the bars they are on.
Personally, regardless of his sentence, I would haunt the perv for the rest of mine and his natural life - I would follow him forever and wherever he went, as best I could, I would inform everyone of what he has done - (keep hold of official documentation).
I hope he gets more than a community rehab programme, slap on the wrist, I really do - it's time we got tough with these particular freaks of nature!
these cases disgust me being an abused child myself my abuser molested 9 children was only charged on 4 of the cases and only got 1 year in jail it's disgusting people need to fight for stronger laws regarding these things hopefully the judge you get is a mean one
The law can be an a**, and his lawyers need to be ashamed of themselves. The rule of law is one thing but what about moral standards, I feel for you and your step daughter. That monster has no place in your family.

I'm curious, but is there really any such thing as a "decent assault" on a minor? Dumb question, I know, but the legistators who come up with this kind of legal lingo probably have their minds on lunch. It's child rape, plain and simple. My guess is a few years in jail, and a great deal of probation where agents from the state can randomly come into his home and inspect his lifestyle to ensure he's not coming into any sort of contact with any other kids.
After the Jehovah's witness case yesterday, be prepared for the worst. but he should certainly lose his job as a convicted criminal.

Don't hold your hopes out. If recent cases are anything to go by, the judges usually hand out community service orders to those found guilty of sexually assaulting a child. Especially if the guilty person happens to be a Jehovah's Witness.
The aggravated circumstances ie position of trust, family etc, may sway the judge to be harsher. A jail term is imminent, and can be upto 4yrs. It depends on reports and psyciatric reports. The judge has to follow guidelines.
